INTRODUCTION (1)

This "Privacy Notice" describes how Pio AS (“Pio” or “we“) process your personal data through pio.com, and in connection with our marketing and delivery of Pio. This Privacy Notice furthermore describes which rights you have under the General Data Protection Regulation (Regulation (EU) 2016/679) and the Norwegian data protection legislation (together “Data Protection Legislation“) in connection with the above processing activities.

RESPONSIBILITY (2)

As a “controller”AutoStore is responsible for complying with applicable Data Protection Legislation when we process your personal data.

WHAT IS PERSONAL DATA? (3)

Personal data means any information relating to an identified or identifiable natural person (a “data subject“). Examples of personal data are your name, phone number, address,and email address.

WHOM DO WE PROCESS PERSONAL DATA ABOUT? (4)

This Privacy Notice addresses our processing of personal data about the following data subjects:

Distributors’, partners’, and suppliers’ representatives and personnel
Representatives and personnel of potential distributors, partners, and suppliers, as well as potential end users of our systems and solutions
End users of our systems and solutions
Job applicants and candidates
Visitors to our premises

THE PERSONAL DATA PROCESSED BY AUTOSTORE (5)

NEWSLETTERS AND EMAIL MARKETING (5.1)

We process your contact details (i.e. name, email address, and salutation), your country of residence, and information regarding the company you are working for, for the purpose of sending newsletters and marketing emails to you.

GENERAL MARKETING AND SALES ACTIVITIES (5.2)

We collect, generate,and process personal data for marketing activities directed at existing/potential end users of our systems, as well as for marketing and sales activities directed at our distributors and partners. We collect and process contact details (i.e. name, email address, postal address, phone number, and job title) for marketing and sales purposes.

COMMUNICATION (5.3)

We collect and process personal data to communicate with end users, and with distributors’,partners’, and suppliers’ personnel and representatives. We will retain emails and other communications with the data subject.

AGREEMENTS (5.4)

We collect and process signatures, names, and contact details to administrate agreements we have entered into with our distributors, partners, and suppliers.

RECRUITMENT (5.5)

If you are a job applicant or a potential candidate for any of our positions, we will collect and process the personal data you submit to us in your application, and/or well as personal data we gather in connection with our recruitment process. Examples of the foregoing personal data include your name, contact details, work title, cover letter, CV, test results, diplomas, certifications, employment history,education history, professional qualifications, work and language skills, and statements from references. Please note that we may obtain your personal data from third parties in connection with our recruitment process, such as from recruitment agencies and LinkedIn.

VISITOR MANAGEMENT AND SECURITY (5.6)

We log and keep a list of persons who have visited our premises.

For security reasons, we have video surveillance of dedicated areas of AutoStore premises,which will capture video footage of persons passing through the dedicated areas. These areas are clearly marked.

WHAT IS OUR LEGAL BASIS FOR PROCESSING PERSONAL DATA? (6)

GENERAL INFORMATION (6.1)

We process the personal data described above in this Privacy Notice for purposes related to legitimate AutoStore interests. We have a legitimate interest in communicating with relevant personnel of suppliers, distributors, and partners. We also process the personal data described above in this Privacy Notice for the purpose of determining your relationship with AutoStore, to improve our services, and for the purpose of managing our contractual relationships. We furthermore have a legitimate interest in promoting our systems and products,as well as assessing whether any persons might be interested in the AutoStore systems and products. We also have a legitimate interest in storing signed versions of agreements which we have entered into.

We do not consider our legitimate interest to be overridden by the interests of the data subjects affected by the foregoing processing activities.

FURTHER INFORMATION REGARDING EMAIL MARKETING (6.2)

If AutoStore has an existing contractual relationship with you or your employer, AutoStore will send newsletters and marketing emails to you based on the legitimate interest of AutoStore in promoting its systems, products, and solutions. We do not consider our legitimate interest to be overridden by the interests of the data subjects affected by the foregoing processing activity.

We may also send such newsletters and marketing emails to you if you have subscribed and consented to it. You can unsubscribe from these communications at any time by clicking on "Email Preferences" found at the bottom of each newsletter and marketing email. You may also unsubscribe by contacting us at the contact information found further below in this Privacy Notice.

RECRUITMENT (6.3)

Our processing of job applicants and candidates' personal data is based on our legitimate interest in finding and hiring new personnel.

VISITOR MANAGEMENT AND SECURITY (6.4)

We have a legitimate interest in keeping account of the persons that have visited the AutoStore premises. With respect to video surveillance, we have a legitimate interest in preventing criminal activity in dedicated and vulnerable areas.

DOES AUTOSTORE TRANSFER OR DISCLOSE YOUR DATA TO THIRD PARTIES? (7)

We use external service providers that provide IT services, legal services, financial services and other administrative support services to us. We have entered into agreements with these service providers which among other things obligates them to implement technical and organizational measures to ensure an appropriate level of security, confidentiality, and integrity, as well as to only process the relevant personal data in accordance Data Protection Legislation.

AutoStore may share marketing leads (contact details and potential interest in AutoStore systems and products) to its distributors and partners. It may also share this information, as well as agreements which a AutoStore Group company has entered into, within the AutoStore Group.

Video surveillance footage will only be shared with the police, i.e. in the event this is necessary to investigate potential criminal activities.

We will not disclose your personal data to any other third parties than the third parties described above, unless required to do so under applicable law or as required under a court order.

INTERNATIONAL DATA TRANSFERS (8)

AutoStore will only transfer personal data to countries outside the EU/EEA on the basis of:

Adequacy decisions, where the EU Commission has decided that the relevant country ensures an adequate level of protection
Appropriate safeguards, such as standard data protection clauses adopted by the EU Commission.

DATA RETENTION (9)

We will delete or anonymize personal data when they are no longer necessary in relation to the purposes for which they were collected or otherwise processed, or as otherwise required under the Data Protection Legislation.

We will furthermore delete or anonymize personal data in accordance with the following criteria:

We will, as a rule, delete the personal data of unsuccessful job applicants and candidates after our recruitment process has been completed, unless the job applicant/candidate consents to our further processing of his/her personal data.

A list of visitors is stored electronically for a maximum of 2 years after the visit.
Video surveillance footage will be deleted within reasonable intervals, unless further storage is necessary for the purpose of investigating criminal activity.

YOUR DATA PROTECTION RIGHTS (10)

Under the Data Protection Legislation, you have certain rights. The rights available to you depend among other things on our reason for processing your personal data. You have the following rights in connection with our processing of your personal data:

Access: You may contact us if you want to obtain confirmation about whether or not we are processing your personal data, and access to and further information regarding our processing of your personal data.
Rectification: You may request us to rectify and/or complete inaccurate or incomplete personal data.
Erasure: You may request that we erase your personal data. We will respect and comply with your request unless we, among other things, are prohibited from deleting your personal data under mandatory retention requirements, or if further processing of the personal data is necessary for the establishment, exercise, or defense of legal claims.
Restriction of processing: You may also request the restriction of our processing of your personal data in accordance with the Data Protection Legislation. If the processing has been restricted, such personal data will, with the exception of storage, only be processed with your consent or for the exercise or defense of legal claims or for the protection of the rights of another person or for reasons of important public interest.
Right to object: You are entitled to object to certain processing activities, including, for example, processing of your personal data for marketing purposes. You are furthermore on grounds relating to your particular situation (for example, a specific need for protection of your identity), entitled to object to processing of personal data based on legitimate interests, which we will comply with, unless there exists compelling legitimate grounds for our processing which override your interest, or if our processing is necessary for the establishment, exercise, or defense of legal claims.
Data portability: If we process your personal data based on consent or based on our performance of a contract, and the processing is carried out by automated means, you may request us to transfer the personal data to you or another controller, in a structured, commonly used, and machine-readable format.

Please also note we may request the provision of additional information, if such information is necessary to confirm your identity.

SECURITY (11)

As a controller AutoStore is responsible for the security and confidentiality of the personal data we process. We are also responsible for implementing appropriate technical and organizational measures to ensure an appropriate level of security of processing.

Due to security reasons we are not entitled to disclose detailed information on the security measures which we have implemented. However, all of our employees are bound by a duty of confidentiality with respect to the personal data which we process.We have furthermore implemented technical and organizational measures, policies and routines to ensure the security of our processing.

THE NORWEGIAN DATA PROTECTION AUTHORITY (DATATILSYNET) AND OTHER SUPERVISORY AUTHORITIES (12)

The Norwegian Data Protection Authority (Datatilsynet) is responsible for supervising Norwegian companies’ processing of personal data. You may contact us at any time if you have any complaints regarding our processing of your personal data. You may also file a complaint with the Norwegian Data Protection Authority, or a data protection authority in the EU/EEA Member State where you live or work, or where the alleged data protection infringement takes place.

CHANGES (13)

We may revise this Privacy Notice, for example due to changes in our processing activities,applicable Data Protection Legislation, or other legislation which may affect our processing of personal data.
